Terms of use
Applies to the use of namely.studio
1. Scope
These terms govern the relationship between KYVEN GmbH, Außerungenach 5, 4850 Timelkam, Austria (operator of namely.studio, see imprint), and everyone who uses the service. By using the website you accept these terms. If you do not agree, please do not use the service.
2. Description of the service
namely.studio is an AI-powered web application that generates brand names, rationales, domain availability checks and logo suggestions. The service can be used within a free quota and in paid plans.
2a. Paid plans
Paid plans are billed through the payment provider Stripe. Prices, scope and term are as shown on the pricing page at the time of ordering. Subscriptions renew for their term (month or year) until cancelled. You can cancel at any time via the customer portal, effective at the end of the current billing period; the plan remains usable until then.
3. Rights to the results
You may use the generated names and logo images freely for your own purposes, including commercial use. HOWEVER: neither trademark protection nor domain availability are guaranteed. Before any trademark filing, company registration or domain purchase you must conduct independent and complete research — ideally with legal advice in the relevant jurisdiction(s).
4. User obligations
By using the service you agree:
- not to enter sensitive personal data of third parties, trade secrets or confidential information into the brief — the brief is transmitted to external AI services;
- not to use the service for unlawful purposes (e.g. to create trademark-infringing, defamatory, discriminatory or violence-glorifying content);
- not to abuse the service via automation (scraping, bots, mass requests) — rate limits are technically enforced;
- to perform an independent trademark check on any generated name before any commercial use.
5. AI-generated content
All names and logos are produced by external language and image models (details in the privacy policy). AI models can produce flawed, hallucinated, or unintentionally similar results to existing brands. The operator does NOT review the results for content. You alone are responsible for verifying whether a generated name is suitable, free and legally usable.
6. Disclaimer of liability
The service is provided "as is". The operator is liable only for intent and gross negligence; this does not apply to personal injury. In particular, no liability is accepted for: trademark conflicts with generated names, damage from registering blocked domains, business interruption or lost profits, data loss through cookie deletion or server failure, content from external AI services.
7. Availability & changes
The operator may further develop the service, change features and adjust the scope of the free quota. Changes to these terms that affect existing paid plans will be announced in advance. The current version is always available at this URL.
8. Privacy & cookies
The privacy policy at /en/privacy describes data processing, necessary cookies, integrated services and internal statistics. Additional analysis of referral sources and campaigns to measure website entries and new registrations requires separate, voluntary consent. It uses a short-lived attribution cookie and aggregated counters; the privacy policy explains the data, retention periods and your rights. Accepting these terms, registering or simply using the service does not constitute consent to this optional analysis. Refusing or withdrawing consent through “Privacy settings” does not restrict use of the service.
9. Governing law & jurisdiction
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers resident in the EU, the mandatory provisions of the country of residence apply additionally. As far as legally permissible, the place of jurisdiction for entrepreneurs is the operator's seat (District Court of Vöcklabruck, Austria).
10. Severability
Should any provision of these terms be or become invalid, the validity of the remaining provisions remains unaffected. The invalid provision is replaced by the corresponding statutory rule.
